Welcome to Berry. These Terms and Conditions govern the use of our website, mobile application, and travel-related services. By accessing our website, making an inquiry, requesting a quotation, making a booking, or using our services, you agree to be bound by these Terms and Conditions.

1. Role of Mediator
- I act solely as an independent mediator/referral agent and do not own, operate, manage, or control any travel, transportation, accommodation, or tour services.
- My role is limited to introducing customers to third-party vendors/service providers.

2. Vendor Responsibility
- All services are provided directly by the respective vendor.
- The vendor is solely responsible for service quality, pricing, safety, permits, licenses, schedules, and fulfillment of the booked services.

3. No Liability
- I shall not be liable for any loss, injury, accident, death, theft, damage, delay, cancellation, service deficiency, misconduct, negligence, or any other issue arising from the acts or omissions of the vendor or any third party.
- Customers participate in the trip at their own risk.

4. Third-Party Acts
- I shall not be responsible for the acts, omissions, negligence, or misconduct of any third party, including transport operators, hotels, guides, or activity providers.

5. Payments and Refunds
- Payments made to vendors are subject to the vendor's policies and terms.
- Any refund, cancellation, rescheduling, or compensation request must be made directly to the vendor.
- I am not responsible for processing refunds unless expressly agreed in writing.

6. Price Changes
- Vendors may revise prices due to fuel costs, taxes, government regulations, or other factors. I am not responsible for such changes.

7. Force Majeure
- I shall not be responsible for any interruption, cancellation, or change in travel plans caused by events beyond reasonable control, including natural disasters, floods, storms, pandemics, government restrictions, strikes, civil unrest, or transportation disruptions.

8. Independent Agreements
- Any agreement, booking, contract, payment arrangement, or transaction made between a customer and an employer/service provider is solely between those parties.

9. Information Accuracy
- Trip details, prices, schedules, and availability are provided by the vendor. I do not guarantee the accuracy or completeness of such information.

10. User Responsibility
- Verifying the identity and credentials of the other party.
- Reviewing all trip details before making any agreement.
- Complying with applicable laws and regulations.
- Conducting transactions at their own discretion and risk.
- We act only as a mediator and are not responsible or liable for any acts, omissions, communications, marketing activities, misuse of information, negligence, or unauthorized actions of any third-party vendor or travel agency after the information has been shared. Any dispute regarding the use of customer information or the services provided by a third party shall be resolved directly between the customer and the respective third party. One Important note: Under Indian privacy laws, you should actually obtain the customer's consent before sharing their personal details with multiple travel agencies. Including this clause helps document that consent, but you should also have the customer agree to it (for example, by signing the terms or accepting them electronically).

11. Limitation of Liability
- To the maximum extent permitted by applicable law, I shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the booking or travel services.

12. Indemnification
- The customer agrees to indemnify and hold me harmless from any claims, losses, liabilities, damages, costs, or legal expenses arising out of the customer's actions, travel participation, or disputes with the vendor.

13. Disputes
- Any dispute regarding travel services must first be addressed with the respective travel provider. We may assist in communication but are not a party to the service agreement between the customer and the provider.

14. Intellectual Property
- All website content including logos, text, graphics, images, designs, and trademarks are the property of the Company and may not be reproduced without prior written permission.

15. Changes to Terms
- We reserve the right to modify these Terms and Conditions at any time. Updated terms will be posted on the website.

16. Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
- Any dispute relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts having jurisdiction over my principal place of business.

- By proceeding with the booking, the customer confirms that they have read, understood, and agreed to these Terms and Conditions.
